Whenever conflict arises the individuals involved have a choice of how to attempt a resolution of that conflict. For some types of conflict litigation can be an all consuming process that takes your focus off of what is important to you like your business and family and forces you into a specific set of results. This process can be very stressful and can result in an all or nothing resolution that destroys relationships and adds unneeded stress to your life.
All disputes have the potential to turn ugly. No resolution to the dispute is going to make everyone happy. However, the goal of dispute resolution is not to make anyone happy, but rather to resolve a conflict that will limit the amount of damage to the things that matter most. My role is to be an advocate for both parties, to find common ground and defuse emotions. My goal is to concentrate on the facts. By maintaining focus, I can help the parties work to a solution that makes sense and is considered fair.
Mediation is a strictly voluntary process with the goal of reaching a resolution to a conflict before the parties feel legal proceedings are the only option.
Mediation is an informal process. I will obtain background information from both parties prior to the mediation in order to gain some familiarity with the issues. At the mediation, I will ask many questions of both parties in order to gain a complete understanding of the facts and issues. With this knowledge, I will talk with both parties, either together or separately, in order to allow the parties to again begin to communicate effectively with each other and ultimately create a resolution to the conflict. I will utilize my knowledge to help educate the parties where I feel it is appropriate. My goal is to get the parties to move toward a solution that both parties feel is fair.
